PPACA Marketplace Notice – Send by October 1, 2013
Under the Patient Protection and Affordable Care Act (PPACA), employers are required to provide a notice to their current employees of coverage options available through a Health Insurance Marketplace, previously called an exchange, by October 1, 2013. Employers must also provide the notice within 14 days of a new hire’s start date on or after October 1st. The notice informs the employee of the existence of the Marketplace including a description of the services provided by the Marketplace.
The notice must be provided to all employees, full-time and part-time, but does not need to be distributed to dependents and former employees, including those on COBRA. The notice may be sent by first-class mail or electronically if it meets the DOL’s electronic disclosure safe harbor rules.
The Massachusetts Health Connector has also released its own template of the Marketplace notice. The use of this particular form is entirely optional for Massachusetts employers. William Gallagher Associates advises our clients to use the federally-developed template that was released by the U.S. Department of Labor.
