CMS Delays Health Plan Identifier (HPID) Requirement

In a surprise move, CMS announced that effective Friday, October 31st there would be a delay in the enforcement of the regulations surrounding the Health Plan Identifier (HPID) until further notice. According to the CMS, this enforcement delay applies to all HIPAA-covered entities, including healthcare providers, health plans, and healthcare clearinghouses.

The delay follows the National Committee on Vital and Health Statistics (NCVHS), an advisory body to HHS, recommendation that HHS rectify in rule-making that all covered entities not use the HPID in the HIPAA transactions. This enforcement discretion will allow HHS to review the advice and consider any appropriate next steps.

For applicable group health plans that have not yet obtained an HPID, there will be no penalties for missing the Nov. 5th deadline.
