Attention Employers: New Deadline for Health Insurance Marketplace Notice: October 1, 2013

Under the Patient Protection and Affordable Care Act (PPACA), employers are required to provide a notice to their employees of coverage options available through a Health Insurance Marketplace, previously called an exchange. Initially the deadline for providing such notice was March 1, 2013 but became delayed until further guidance was issued.

This week, the U.S. Department of Labor (DOL) released the Marketplace model notice which must be distributed to all employees, regardless of their plan enrollment. Current employees must receive this notice no later than October 1, 2013. Employers must also provide the notice to each new hire beginning October 1, 2013. The notice may be distributed electronically if it satisfies the DOL’s electronic disclosure safe harbor or it may be provided by first-class mail.

Revised COBRA Election Notice

In addition to the model Marketplace notice, the DOL released a model COBRA election notice that plans may use to satisfy the requirement to provide the election notice under COBRA. This notice is being revised to help make qualified beneficiaries aware of other coverage options available in the Marketplace.
